Value Added Tax
The Ministry of Revenues and Duties of Ukraine by the letter № 10803/6/99-99-19-04-02-15 of 10.09.2013 clarified question on the procedure for filling by the investor (operator) of VAT tax declaration as part of the Production Sharing Agreement.
The Cabinet of Ministers of Ukraine by the resolution № 766 of 09.10.2013 established:
- maximum amount of issuance of financial treasury bills to repay the actual budget debt of holders (recipients) of budget funds to be restructuring in the amount of 3,599,214.2 thousand UAH;
- maximum amount of issuance of financial treasury bills for financial compensation from the budget of VAT amounts generated by the results of the inventory by the Ministry of revenues and duties of claimed for the recovery of VAT amounts and calculation of forecast indicators of the tax amount on tax declarations, which will be presented to the November 1, 2013, in the amount of 12,026,500 thousand UAH.
The Ministry of Revenues and Duties of Ukraine by the letter № 18803/7/99-99-19-04-02-17 of 20.09.2013 clarified issues regarding of mapping by an agricultural enterprise-subject of a special regime of taxation on value-added of prepayment operations (advance payment) for delivery of agricultural products of the future harvest. The Ministry reports: if agricultural commodity producer-subject of special tax regime under the terms of the concluded contract receives advance payment for agricultural products of own production, on the date of prepayment for such products of own production (first event) it determines the tax liability in a transaction of such goods/services supply, make out tax invoice to the buyer on such transaction following the standard procedure. In the future, such operation should be recorded by subject of special tax regime in the tax return on the value added tax with a mark “'0121”/”0122”/”0123”, which is provided on the results of the corresponding reporting period in which received the prepayment for agricultural products.
The Ministry of Revenues and Duties of Ukraine by the order № 536 of 07.10.2013 approved the Generalizing tax advice regarding the VAT features of operations for the software products supply. In consultation indicated that operations with supply of software products with the transfer of property rights to such products (in accordance with the contract on transfer of exclusive intellectual property rights) shall be exempt from VAT regardless of whether such products are delivered on tangible media or transferred to the buyer by other way including Internet network, email or other means of transmission.
Other taxes and duties
The Ministry of Revenues and Duties of Ukraine by the letter № 22250/7/99-99-15-04-01-17 “On the witnessing of certificates” of 25.10.2013 recalled that by the decision № 685 of the Cabinet of Ministers of 18.09.2013 approved the form of the certificate of environmental tax payment for the scrappage of decommissioned motor vehicles and form of the certificate of exemption from the environmental tax for the scrappage of decommissioned vehicles. According to paragraph 2 of the resolution before the issue of certificates for payment of environmental tax for the vehicles and on the exemption from the environmental tax for the vehicles as strict reporting forms, in particular, the revenues and duties authorities at import of vehicles into the customs territory of Ukraine issued the above certificates on samples approved by that resolution.
The Ministry of Revenues and Duties of Ukraine by the letter № 10807/6/99-99-19-04-03-15 of 10.09.2013 noted that the issuance, registration, paying of bill are not subject to a special taxation in accordance with subpar. 213.2.4 of the Tax Code of Ukraine (TCU). However, the operation of endorsement (remittance of bill) is subject to taxation by special tax in accordance with subpar. 213.1.7 of par. 213.1 of Art. 213 of the TCU, as it provide the transfer of ownership to securities to another person. Such transactions are taxed at a rate of 1.5% from the transaction amount for the sale of securities outside the stock exchange which are not in the stock register in accordance with subpar. 215.1.1.4 of par. 215.1.1 of Article 215.1 of the TCU.
The Verkhovna Rada of Ukraine approved and the President signed the Law of Ukraine “On Amendments to the Tax Code of Ukraine, concerning the registration of persons as taxpayers” of 05.09.2013 № 443-VII. The document, in particular, states that taxpayers, who concluded with the relevant supervisory authority an agreement on the recognition of electronic documents, can submit a registration application for voluntary registration by electronic means in electronic form by reporting individuals signing in accordance with the law. In addition, provided that the registration of application for voluntary registration by VAT payer and application for choice of a simplified tax system may be submitted to the state registrar as a supplement to the registration card which is submitted for the state registration of legal entity or individual-entrepreneur. An electronic copy of statements, made by scanning, is transferred by the state registrar to supervisory authorities simultaneously with the information from registration card for the state registration of a legal entity or an individual-entrepreneur in accordance with the Law “On state registration of legal entities and individuals-entrepreneurs”.
The Ministry of Revenues and Duties of Ukraine by the letter № 5074/6/99-99-17-02-01-15 of 17.06.2013 clarified issues regarding recognition in the income tax return on №1-ДФ form PIT compensation amounts, withheld from pay service, cash bonuses and other payments of the military servicemen. The ministry reported: monetary compensation of tax on personal income, withheld from pay service, cash bonuses and other payments of the military servicemen, is not displayed in the income tax return on №1-ДФ form, because it is not subject to taxation.
Customs policy
The Ministry of Revenues and Duties of Ukraine by the letter № 22232/7/99-99-24-01-10-17 “On the customs clearance of wood packaging material” of 25.10.2013 noted that in carrying out at checkpoints across state border of Ukraine of customs control and the customs clearance of goods, which are accompanied by wood packaging material must be guided by paragraph 9 of the Procedure on the preliminary documentary control at checkpoints across the state border of Ukraine.
The Verkhovna Rada of Ukraine adopted and the President signed the Law of Ukraine № 584-VII “On Customs Tariff of Ukraine” of 19.09.2013. The Customs tariff of Ukraine is an integral part of the document and contains a list of national tax rates - import duty on goods imported into the customs territory of Ukraine and classified according to the Ukrainian Classification of Goods for Foreign Economic Activity, drawn up based on the Harmonized Commodity Description and Coding. There are provided that the rates of import duty may be established or changed only by amending the Customs Tariff of Ukraine in the manner specified by the law.
Single social contribution
The Ministry of Revenues and Duties of Ukraine by the Order № 458 of 09.09.2013 approved the Procedure for registration of single fee payers for obligatory state social insurance, which identifies issues of registration, changes to the credentials and de-registration of payers of the single payment on obligatory state social insurance at authorities of revenues and duties, supplying to the authorities of revenues and duties of information about the class of occupational risk of production by the Social insurance against accidents and occupational diseases in Ukraine, providing to Pension fund and compulsory state social insurance funds of data on registration/deregistration of a single fee payers.
The Ministry of Revenues and Duties of Ukraine by the Order № 452 of 09.09.2013 approved the Procedure of grievance by revenues and duties authorities for payment of outstanding debt at the payment of a single fee for obligatory state social insurance and the decision of the assessment of penalties and fines. The complainant has the right to appeal against the claim, the decision of the assessment of penalties and fines imposed at any time after receipt of the claim or judgment. Requirement or decision of revenues and duties authorities on payment of penalties and the imposition of a fine, for which is filed a claim in court, not subject to appeal in accordance with the requirements of this Procedure. At the same time the complainant shall notify the revenues and duties authorities, which shall consider the complaint on each case of judicial review of its claims or decisions of the assessment of penalties and fines.
The Ministry of Revenues and Duties of Ukraine by the Order № 450 of 09.09.2013 approved the Procedure on entering against future payments of single fee for compulsory social insurance or return of overly and/or erroneously paid.
Control and responsibility
The Ministry of Internal Affairs of Ukraine by the order № 898 of 18.09.2013 approved the Instruction for preparation of materials on administrative offenses’ cases by the officials of the State Border Service of Ukraine. The document defines the procedure for preparation, consideration and recording of materials on administrative offenses, the countering of which is within the competence the State Border Service. Thus, it is envisaged, that on each fact of an administrative offense, countering to which by law is within the competence Border Service, develop a protocol on administrative violation.
The Verkhovna Rada of Ukraine adopted and the President signed the Law of Ukraine № 590-VII “On amendments to some legislative acts of Ukraine concerning the payment of the court fee” of 19.09.2013. Fees introduced by law in cases on administrative offenses.
Thus, it is determined that the court fee in the proceedings of an administrative offense if the court (judge) make decision to impose an administrative penalty is payable by the person to which the penalty is imposed. State tax rate in case of acceptance court rules on the imposition of an administrative penalty is 0.03 of the minimum wage.
The Cabinet of Ministers of Ukraine by resolution № 727 of 02.10.2013 ”On amendments to paragraph 2 of the Regulation on the procedure for imposition and exaction of fines for violation of the consumer protection legislation, decided to fine the economic entities for the restriction or denial of the rights of consumers regarding the free choice of products and its forms of payment. Sum of the penalty is 8500 UAH.
The Ministry of Economic Development and Trade of Ukraine by the order № 1064 of 03.09.2013 approved the Procedure on monitoring compliance with requirements of legislation for issuance of permit documents. It defines a mechanism of control over compliance by state administrators, licensing authorities (their officials) of requirements of the legislation for issuing permits, according to the manner of their issuance (including by the permit centers), creation and operation of licensing centers by city councils of cities of regional and/or national importance (their executive agencies), by the district in the Kyiv and Sevastopol city state administrations, Kyiv and Sevastopol city state administrations.
The Ministry of Agrarian Policy and Food of Ukraine by the Order № 544 of 11.09.2013 approved the List of issues for the implementation of planned measures of state supervision (control) for breeding livestock and unified form of inspection report of compliance in breeding livestock.
The Ministry of Energy and Coal Industry of Ukraine by the Order № 599 of 28.08.2013 approved the Labour protection Rules at the facilities of the synthetic detergents production which extend to entities regardless of ownership and legal form, engaged in the production of synthetic detergents. These rules establish requirements for safety during the production of synthetic detergents.
The Ministry of Energy and Coal Industry of Ukraine by the Order № 600 of 28.08.2013 approved the Labor protection rules at facilities for the production of household chemicals which apply to business entities regardless of ownership and organizational-legal form, engaged in activities for the production of household chemicals. These Rules prescribe the requirements of labor protection in the production of household chemicals and do not apply to entities which operate for the production of artificial and prepared waxes.
The Cabinet of Ministers of Ukraine by the Resolution № 704 of 26.06.2013 amended the Procedure on the dimensions and weight control and toll collection of public roads by transport vehicles and other self-propelled machinery, weight and/or size parameters of which exceed normative, which stipulating, that dimensions and weight control at fixed checkpoint includes a documentary, a preliminary and/or precise control, at the mobile – documentary, precise control.
The Verkhovna Rada of Ukraine adopted and the President signed the Law of Ukraine № 442-VII “On Amendments to Some Laws of Ukraine regarding the reducing of the permit documents number which should receive by the food market operators” of 05.09.2013. In particular, from the Law of Ukraine “On Beekeeping” was excluded position on the need for certification of bee products, which are exported from Ukraine.
Labour and salaries
The Ministry of Social Policy of Ukraine by the letter № 23/06/187-13 of 09.04.2013 regarding employment record book of deceased employee reported that in the case of death of the employee employment record book is handed to his immediate family members against signed acknowledgement or sent by post on request. In the employment record book of deceased employee in the section “Information about the work” and the date of entry in column 3 is made an entry: “Work stopped due to the death”, then – filled column 4 – the date and number of the order (directive). This record shall be certified in the prescribed manner.
Securities
The National Securities and Stock Market Commission of Ukraine (NSSMC) by the decision № 1248 of 16.07.2013 approved amendments to the Procedure on maintenance of the Registry of Audit Firms eligible to audit professional participants of the securities market. Changes, in particular, provides that for entering into the specified Register the audit firm must file to the NSSMC a questionnaire of business reputation of the audit firm and the information related to the head people and audit firm employees who exactly will take part in the inspection of professional participants of the securities market.
The National Securities and Stock Market Commission of Ukraine (NSSMC) by the decision № 1681 of 03.09.2013 approved the Regulations on requirements for the standard form of bills and notes, which, inter alia, determined that for printing of the bill forms can be used intaglio printing. In addition, at manufacturing of bills forms not be used holographic protecting elements.
The National Securities and Stock Market Commission (NSSMC) by the Decision № 1412 of 06.08.2013 approved the Requirements for contract on the securities account service which are distributed to the owners, including the state/territorial community, securities management of which carries out by entity of management of objects of state/communal property, determined in accordance with the law, co-owners of the securities, notaries, on the deposit of which made to the securities and depository institutions at the conclusion of a service contract on securities account service, changing of it.
The National Securities and Stock Market Commission (NSSMC) by the Decision № 1526 of 20.08.2013 approved Requirements for contract on maintenance of clearing agency and Clearing House for Contracts Traded on Financial Markets, which apply to the clearing agencies, Clearing House for Contracts Traded on Financial Markets and the Central Securities Depository at the conclusion of a service contract of clearing agency and Clearing House for Contracts Traded on Financial Markets, amendments to the agreement.
The National Securities and Stock Market Commission (NSSMC) by the Decision № 1281 of 23.07.2013 approved the License terms of professional activity on the stock market (securities market) – asset management activities of institutional investors (asset management), which establishes the procedure for issuing, reissuing of licenses for professional activity on the stock market – the asset management activities of institutional investors (asset management) and the issuance of a duplicate copy of such a license, the order of suspension and revocation of the license, the terms of the license issuing and the exercise of the professional activities.
The National Securities and Stock Market Commission of Ukraine (NSSMC) by decision № 1464 of 13.08.2013 “On approval of the Regulation for certification of specialists for stock market” approved a requirement which stipulates that only experts with impeccable business reputation can be certified to carry out activities related direct implementation of professional activity on the stock market. To confirm the impeccable reputation specialists will need to fill out a questionnaire which is supplied together with other documents for the certification.
The National Securities and Stock Market Commission of Ukraine (NSSMC) by decision № 1753 of 10.09.2013 approved the Regulations on the composition and structure of assets of collective investment scheme. Requirements relating to the structure of assets of collective investment scheme established by the Law “On collective investment scheme” and the aforementioned Regulations shall apply to:
- unit investment fund within six months from the date of issue prospectus registration of the fund's investment certificates by NSSMC;
- corporate investment fund within six months from the date of registration of the rules of such fund by NSSMC.
The National Securities and Stock Market Commission of Ukraine (NSSMC) by decision № 1600 of 28.08.2013 changed the Procedure for audits conducting of issuers of securities by which:
- established that as the date, from which starts the time limin counting for determining of the next scheduled inspection beginning, is the date of the end of the previous scheduled inspection;
- obliged NSSMC not only to notify the issuer about conducting of scheduled inspection, but also by placing of the schedule of inspections on its official website;
- expanded the list of reasons for unscheduled inspections.
The National Securities and Stock Market Commission of Ukraine (NSSMC) by decision № 1413 of 06.08.2013 approved Requirements for the agreement on maintenance of securities issues between the issuer and the Central Depository. Central Securities Depository within one year from the date of enactment of the Law of Ukraine “On the Depository System of Ukraine” implement actions to bring of agreement on the issue of securities, concluded by issuers before the entry into force of this Law, in accordance with the requirements.
The National Securities and Stock Market Commission (NSSMC) by the Decision № 1416 of 06.08.2013 approved the declaration Procedure of issuance of securities as unfair and invalid, the effect of which apply to equity securities, registration of which carries by registration authority, namely: stocks, corporate bonds, internal bonds, mortgage certificates, mortgage certificates, certificates of real estate funds, option certificates and does not apply to the activities of joint investment emission activities.
The National Securities and Stock Market Commission of Ukraine (NSSMC) by the Decision № 1415 of 06.08.2013 approved the Procedure of repurchased stocks cancellation by joint-stock company without the share capital changing.
Financial Services Market
The State Commission for Regulation of Financial Services Markets in Ukraine by the regulation № 2979 of 22.08.2013 approved amendments to the Regulations on disclosure of information about non-state (private) pension fund. Changes, in particular, provides that private pension fund administrator no later than 30 April of the year following the reporting year is required to make public by posting on the site of non-state pension fund and/or of the fund administrator the information about the Fund for the reporting year.
The State Commission for Regulation of Financial Services Markets in Ukraine by the order № 2362 of 18.07.2013 established the Procedure for agreement of the organization charter (changes in the charter) and the registration of pension schemes (changes to the pension scheme) of non-state pension fund. Charter of the pension fund is submitting at agreement in the State Commission for Regulation of Financial Services Markets in Ukraine for state registration of the pension fund as a legal entity. Pension schemes submitted for registration to the State Commission for Regulation of Financial Services Markets in Ukraine after entering of pension fund in State Register of financial institutions.
Others things
The National Television and Radio Broadcasting Council of Ukraine by the decision № 1775 of 18.09.2013 amended the Regulations on the abolition of sanctions “make warning” applied by the National Council for the breach of the license and the breach of legislation of Ukraine by the TV and radio organizations and providers of program service, in accordance with which sanction “make warning”, applied for breach of the license and requirements of the current legislation in the field on television and radio under license, which was revoked or invalidated, is considered automatically as canceled and not included during further activity of the licensee.
The Ministry of Energy and Coal Industry of Ukraine by the order № 601 of 28.08.2013 approved the Norms of free issue of special clothing, special footwear and other personal protective equipment to employees of materials and products manufacturing, based on chrysotile asbestos. Norms apply to the economic entities, regardless of ownership and organizational and legal form, engaged in activities aimed at producing of materials and products based on chrysotile asbestos.
The Ministry of Infrastructure of Ukraine by the order № 651 of 30.08.2013 recognized as being invalid the order of the Ministry of Transportation and Communication of Ukraine № 156 of 06.05.1997 “On approval of the Procedure of certification of drivers engaged in ethanol transportation and transport facilities used for this”.
The Ministry of Industrial Policy of Ukraine by order № 6, dated 09.18.2013, has approved Application form for creation (modernization) of production capacity and workplaces and the Procedure on the development of this program. In particular, it is determined, that the entity that, in accordance with the determination of the goods imported into the customs territory of Ukraine for use in the industrial production of motor vehicles, creates (modernizes) the production capacity for the industrial production of transport vehicles, shall submit to the Ministry of Industrial Policy the developed by it Program in three copies.
The National Bank of Ukraine by the Resolution № 377 of 24.09.2013 found that in the IV quarter of 2013 transactions in the foreign exchange market might be made by it in the form of:
- interventions according to the single rate for smoothing of excessive exchange rate fluctuations – according to the situation on interbank foreign exchange market of Ukraine;
- targeted interventions – in case of urgent needs of national importance.
The Verkhovna Rada of Ukraine approved and the President signed the Law of Ukraine “On the production and circulation of organic agricultural products and raw materials” of 03.09.2013 № 425-VII, which defines the legal and economic basis of the production and circulation of such products and raw materials, control measures and monitoring on such activity and is directed at ensuring of fair competition and proper functioning of the market of organic products and raw materials, improvement of population health measures, preservation of the environment, sustainable use of soil, ensuring the effective use and reproduction of natural resources, as well as ensuring of consumer confidence in the products and raw materials labeled as organic.
The Ministry of Energy and Coal Industry of Ukraine by the order № 682 of 20.09.2013 approved Technology for determining of the available or lacking throughput (capacity) Single gas transportation system of Ukraine, which applies to gas transmission, gas distribution companies and the operator of the Single gas transportation system of Ukraine.
The Deposit Insurance Fund, the National Bank of Ukraine, theNational Securities and Stock Market Commission of Ukraine (NSSMC) by the Decisions № 26, 327, 1523 of 20.08.2013 approved the Regulations on the establishment, registration of the shares, the issuance of the banking license and general license for currency transactions to the transition bank, which sets the stages of creating of transition bank, features of registration by the NSSMC of shares issue, the list of documents required for registration of the shares, the requirements for registration of documents submitted for registration of the shares , as well as the procedure for issuing of banking license and general license for currency transactions.
The Ministry of Justice of Ukraine by the order № 2104/5 of 04.10.2013 approved the Professional conduct rules of notaries of Ukraine, defining principles of professional ethics of the notary by which he should be guided in their dealings with public authorities, individuals and legal entities, other notaries.
The Cabinet of Ministers of Ukraine by the Resolution № 702 of 07.08.2013 approved:
Technical regulations for energy labeling of energy consuming products
Technical regulations on energy labeling of household electric refrigerators
Technical regulations on energy labeling of household washing machines.
In addition, there are approved plan of measures on the use of these technical regulations.
The Cabinet of Ministers of Ukraine by the Resolution № 700 of 11.07.2013 approved the Regulations on the testing laboratories chain to determine of the content of genetically modified organisms in products, which laying down basic principles and objectives of the testing laboratories chain to determine of the GMO content in products.
The Verkhovna Rada of Ukraineadopted the Law № 564-VII “On Amendments to Article 59 of the Law of Ukraine “On the use of nuclear energy and radiation safety” regarding the crossing via the customs border of Ukraine and customs clearance of radioactive materials” of 17.09.2013.
The Verkhovna Rada of Ukraine adopted the Law “On Amendments to Section V ”Final Provisions” of the Law of Ukraine ”On regulation of urban development” regarding suspension of the prohibition on the allocation of a land plot” № 606-VII of 19.09.2013, by which is suspended prohibition in the allocation of land plots. The document is allowed to January 1, 2015 in the areas where it is not approved zoning plans or detailed plans of territories:
- to transfer (grant) the land plots from the state or municipal property in the ownership or use of individuals and legal entities for urban planning needs;
- to change the designated purpose of the land.
The Ministry of Energy and Coal Industry of Ukraine by the order № 673 of 18.09.2013 approved the Safety Regulations for operation during the autoclave moulding and gluing of parts and assemblies which apply to all economic entities regardless of ownership and legal forms, whose activities are related to the autoclave moulding and gluing of parts and assemblies.
The Verkhovna Rada of Ukraine adopted and the President signed the Law of Ukraine № 588-VII “On Amendments to the Customs Code of Ukraine”, dated 19.09.2013, which, inter alia, provides that the supply of goods by duty-free shops on board of commercial aircraft, which will perform an international flight from another checkpoint of the border of Ukraine, than the one where is located duty-free shop, carried out under the supervision of officials of the revenues and duties authority on the location of the duty free shop in containers under tariff protection and/or assurance by the holder of the duty free shop.
The Cabinet of Ministers of Ukraine by resolution № 755 of 02.10.2013 approved the Technical Regulation on medical products, which applies to medical products and process aids to them.
The Cabinet of Ministers of Ukraine by resolution № 746 of 09.10.2013 amended the Procedure and terms for the provision of state support to agricultural producers in the insurance of agricultural crops by insurance payments (premiums) easing, which, inter alia, determined that the crop insurance with state support, among others, can be carried out in the case of the organization of mass outbreaks of harmful organisms as well as in the event of outbreak of plants pests.
The Cabinet of Ministers of Ukraine by resolution № 754 of 02.10.2013 approved the Technical Regulation on medical devices for the diagnosis in vitro, which applies to medical devices for in vitro diagnosis and their auxiliaries. This Technical Regulations shall not apply to products which are manufactured and used only within the same health institutions or enterprise without the transfer of these items to another person.
The National Bank of Ukraine by the letter № 29-209/17998 on the practical application of certain requirements of the legal act of the National Bank of Ukraine of 16.10.2013 clarified some questions of application of certain requirements of resolution N 365 of 16.09.2013 “On the receipt of foreign currency to current accounts of individuals within Ukraine”.
The State Sanitary and Epidemiological Service of Ukraine by the letter № 05.03-08-8509/14, dated 11.09.2013, recalled that the Law of Ukraine “On the List of permit documents in the area of economic activity” is classified the conclusion of the state sanitary-epidemiological expertise to permit documents. State sanitary-epidemiological expertise carried out by the state sanitary-epidemiological service, and in particularly difficult cases – by the commissions which are formed by the Chief State Medical Officer. Conclusion by results of state sanitary-epidemiological expertise approved by the relevant chief medical officer.
The Cabinet of Ministers of Ukraine by resolution № 763 of 17.10.2013 approved the Procedure for calculating and applying of the market range of prices and profitability for transfer pricing purposes. The document, in particular, provides that for determining of the market price range use a sample of prices of comparable transactions, ordered in ascending order. To each value of the sample, starting from a minimum, is given a serial number. In the sample is not included price-controlled operation.
The Ministry of Energy and Coal Industry of Ukraine by the order № 702 of 01.10.2013 has approved the Regulations on labor protection in enterprises for the production of plastic products which apply to the entities regardless of ownership and organizational-legal forms, engaging in the production of plastic products. These Regulations prescribe the requirements for labor protection and safety in production of plastic products.
The Ministry of Education and Science of Ukraine by the order № 1355 of 02.10.2013 approved a List of issues for the implementation of the planned activities of state supervision (control) on the use of intellectual property rights. Thus, in particular in implementing of planned activities of state supervision (control) on the use of intellectual property rights examined a number of documents required by the Order.
The National Commission for the State Regulation of Communications and Informatization by the decision № 625 of 24.09.2013 approved the Procedure for tenders and tendering on licenses obtaining for the use of radio frequency resource of Ukraine. Document defines the procedure for the preparation and holding of tenders for licenses obtaining for use the radio frequency resource of Ukraine in the case if declared the need for radio-frequency resource exceeds its actual presence.
The Individual Deposit Guarantee Fund by the decision № 29 of 23.09.2013 amended the Regulations on the Procedure for the register of members of the Individual Deposit Guarantee Fund maintenance, which applies to all banks in Ukraine, except for public joint stock company “State Savings Bank of Ukraine” (before the adoption of the law on the participation of such Bank in the Fund) and remedial bank created before the entry into force of the Law “On the system of guaranteeing deposits of individuals”.
