On November 24, 2021, the Cabinet of Ministers of Ukraine issued Order No. 1493- р “On the operation of the Bureau of Economic Security” (BES), which determined the official start of the BES’s activities to combat offenses that threaten state economy.
As of November 25, the central office of the BES has formed more than 30% of its staff, which allows to start the analytical and law enforcement function of the bureau. Simultaneously with the start of the bureaus work, the staffing of the BES’s central office and the development of its territorial offices will continue.
Despite the decision to officially open the bureau, the body has not yet been provided with specially equipped premises and buildings, which may delay the transfer of existing criminal proceedings to the BES from law enforcement officers who lose their functions of investigating economic offenses.
The Cabinet of Ministers of Ukraine approved changes to the conditions of adaptive quarantine in Ukraine on November 24. The new rules will apply to the ‘yellow’ zone.
According to the changes, the possibility for businesses to work is canceled only taking into account the occupancy of the area of the institution or selective verification of COVID-documents.
Now, in the ‘yellow’ zone, cafes, restaurants, gyms, cultural institutions and public institutions will be able to work only if all staff are vaccinated against coronavirus with at least one dose of vaccine or have a negative PCR test or certificate of recovery.
The same rule applies to visitors to such institutions.
Institutions should not just ask for a COVID-certificate, but be sure to read its QR-code in “Diia”.
The fine to the owners of the institution for improper verification of the certificate will be from UAH 34 to 170 thousand.
The Pension Fund of Ukraine has prepared a draft Resolution “On the procedure and order of submission of information for the creation of electronic employment records”. It can be found on the website of the joint representative body (hereinafter – JRB) of trade unions.
The draft act stipulates that information on employment of an employee, sole proprietors who are self-employed, in electronic form is submitted in any period within five years from the date of entry into force of the Law of Ukraine “On Amendments to some legislative acts of Ukraine on the accounting of labor activity of the employee in electronic form” taking into account the priority of submission and processing of information on labor activity of persons who has two or less years left to an old-age pension in accordance with Part 1 of Art. 26 of the Law of Ukraine “On Compulsory State Pension Insurance”, and on employment of persons for the period up to July 1, 2000.
In addition, it is proposed to approve amendments to the Procedure for submitting information on employment of an employee, sole proprietor, individual who is self-employed, in electronic form, approved by Resolution the Board of the Pension Fund of Ukraine No. 11-1 of March 12, 2021, in order to implement the provisions of the Law of Ukraine No. 1217-IX of February 5, 2021 “On Amendments to Certain Legislative Acts of Ukraine on Accounting for Employment of Employees in Electronic Form”.
The changes stipulate that information on the employee’s employment is submitted to the territorial body of the Pension Fund of Ukraine (hereinafter –PFU) by the employee personally or through the web portal of PFU electronic services in electronic form by the employee, insurer or the insurer’s representative.
It is envisaged that information on the employee’s employment for the period after the entry into force of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Accounting for Employee’s Employment in Electronic Form” is submitted as part of consolidated reporting on personal income tax, military levy and single social contribution.
There is no information in the register of insured persons about hiring, moving from one structural unit to another or transfer to another permanent position or job, dismissal, reinstatement, as well as the assignment, change or deprivation of rank, class, title, category, taking the oath, internship, training, etc. are submitted by the insured through the web portal of electronic services PFU in electronic form by creating an appropriate electronic record in the electronic office of the insurer no later than the day of dismissal.
The Ministry of Digital Transformation of Ukraine has launched new European formats of e-signatures. Users of the Ministry’s resources will be able to check and sign documents with e-signatures of European formats. There is also a unified format for storing signed data – ASiC-E. This is another step towards mutual recognition of e-trust services from the European Union.
The new function is available on the websites of the Central Certification Authority and the Integrated E-Identification System:
CAdES allows you to sign e-data of any format and saves e-signature separately from or together with e-data. Files can only be signed separately.
XAdES allows you to sign e-data of any format and saves e-signature in XML format, separately from or together with e-data. You can sign multiple files at once.
PAdES allows you to sign e-data in PDF format and saves e-signature along with e-data. Files can only be signed separately.
ASiC-E provides long-term storage of e-documents. One of the benefits is the ability to save one or more files with associated e-signatures, verify the entire chain of e-signatures and other data associated with the document.
The Cabinet of Ministers of Ukraine has approved amendments to Resolution No. 835, which expanded the list of open data to be disclosed by mobile operators.
The State Statistics Service will publish the population of Ukraine according to each settlement, instead of forcing people to make official inquiries and wait for a response.
Telecommunications operators will also publish their economic performance for each type of mobile service and by region.
Thus, people will be able to understand how much operators earn on services in certain areas, and understand the interest in investing to improve mobile communications in a particular area. This will help to choose the best operator, who is developing coverage.
The changes will also make the activities of operators in Ukraine more transparent and open, stimulate competition and, as a result, improve the quality of mobile services.
The Verkhovna Rada of Ukraine has adopted the Law “On Administrative Procedure” (draft No. 9456), prepared by the Ministry of Justice of Ukraine.
This is, in fact, the introduction of uniform, transparent and clear rules of interaction between the state, citizens and business.
The law provides for:
- obligation of administrative bodies to justify their decisions;
- granting the participants of administrative legal relations essential procedural rights (the right of a person to be heard before making any individual decision that may adversely affect the person and provide the necessary evidence; the right of each person to access case materials concerning them), which will facilitate the exercise of the constitutional right to appeal;
- establishment of requirements to the form and content of administrative acts and rules of their entry into force;
- determination of the procedure for appealing administrative acts out of court.
The law on administrative procedure is in fact a ‘silent revolution’ that radically changes the Soviet mentality in the interaction of the state with its main stakeholders – citizens. Adoption of the law will ensure equality of all participants in administrative proceedings and common standards in the work of officials, accelerate the provision of more quality and convenient services for citizens.
