The Verkhovna Rada of Ukraine under the № 2903 of 22.04.2013 was registered the draft Law on amendments to some legislative acts of Ukraine concerning protection of investor rights.
The Cabinet of Ministers of Ukraine by resolution on 22 April 2013 № 299 approved the Temporary Procedure for certification of seeds and planting materials, which establishes a procedure for determining and certifying of conformity varietal and sowing qualities of seeds and planting materials at all stages of reproduction.
The Cabinet of Ministers of Ukraine by Resolution of 22.04.2013 № 305 approved the procedure for the formation of special commissions to take measures to prevent a sharp increase of unemployment during mass layoffs. They provide that into case of a mass release of employees initiated by the employer due to part one of Art. 48 of the Law of Ukraine “On population employment”, local state administrations may form the commission, by order of their heads. This order appears on the basis of information provided by territorial authorities of the State Employment Service.
The Ministry of Revenues and Duties of Ukraine by the letter № 88/99-99-22-0318 of 01.04.2013 reminded that the individual (tax agent) has the right independently to apply tax exemptions or reduced of tax rate, provided with relevant international treaty of Ukraine at the time of payment of income by non-resident, if such non-resident is the beneficial (factual) recipient (s) of income and a resident of a country with which concluded an international treaty of Ukraine. In addition, Ministry clarified that confirmation of the beneficial recipient of income - one of the conditions of application of the preferential rate or exemption from tax on income of non-residents.
The Ministry of Agrarian Policy and Food by the Order № 216 of 25.03.2013 approved the procedure of import to Ukraine of seed variety, which is listed in the Register of Plant Varieties of the Organization for economic cooperation and development those agricultural plants, varietal certification schemes to which Ukraine joined, provided that they are intended for reproduction and subsequent export from the country. This Procedure provides that the seeds of plant varieties imported into the customs territory of Ukraine without the right to market for reproduction with the subsequent certification and export of the country.
The Ministry of Agrarian Policy and Food by the Order № 221 of 26.03.2013 approved the rules of the arbitration (the expert) determination of the quality of seeds and planting materials and order of registration of statements.
The Ministry of Agrarian Policy and Food by the Order № 179 of 14.03.2013 approved the procedure for obtaining the documents, materials and other information necessary for the exercise of state supervision (control) over land use and protection.
The Ministry of Agrarian Policy and Food by the Order № 205 of 22.03.2013 approved the changes in the calculation of the proportion of agricultural production.
The Ministry of Finance of Ukraine by the Order № 391 12.03.2013 approved the form of Information about affiliated persons, which is supplied by large taxpayer into Ministry of Revenues and Duties of Ukraine. The Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine by the Order № 95 of 19.03.2013 approved the Procedure of acceptance into operation of the individual (farmstead) houses, garden, holiday buildings, commercial (household) buildings and structures, outbuildings to them, public buildings and buildings for agricultural purposes of I and II categories of difficulty, built without a permit for the construction work and the technical survey of building structures and utilities.
The National Securities and Stock Market Commission (NSSMC) by decision № 429 of 26.03.2013 approved the Regulations on clearing activities, which establishes the procedure for the implementation of such activities, on the implementation of the clearing of securities transactions settlement center on service contracts in the financial markets, the central securities depository and clearing agencies, including the procedure for clearing of securities transactions by persons who act as a central counterparty, the order of creation and use of a guarantee fund in the form of securities and other financial instruments, as well as procedures for monitoring of the implementation of clearing activities.
The Interdepartmental Commission on International Trade announced its decision № СП-288/2013/4423-06 of 11.04.2013, which amended the judgment of 28.04.2012 № СП-275/2012/4423-08 “On the application of special measures concerning the import into Ukraine of passenger cars regardless of the country of origin and exports”, according to which special measures are not applied regarding of import to Ukraine of cars and other motor vehicles principally designed for transportation of people (category M1 - vehicles that have at least 4 wheels used for the carriage of passengers and comprising no more than eight seats, except the driver's seat), with the an internal combustion engine with spark ignition and crank drive with the a cylinder capacity exceeding 1000 cm3 but not exceeding 2200 cm3, new ones that are classified according to UCT ZED (Ukrainian classification of foreign economics goods) by codes 8703 22 10 00 and 8703 00 23 19 10 have a hybrid propulsion system (electric motor with drive to wheels of the car) to 28.02.2014.
The State Tax Service of Ukraine by the letter № 4198/6/18-3115 of 18.03.2013 noted that for registration of non-resident permanent representative offices of foreign legal entities are required to apply within 10 calendar days from the date of state registration (accreditation, validation) in the established procedure to the authorities of STS at its location.
Representative office of foreign company or permanent establishment shall be submitted to the of STS Authority at its location: the relevant application form, a copy of the document confirming the assignment of Unified State Register of enterprises and organizations of Ukraine (USREOU) code, and a copy of the document of registration, validation, accreditation, creation, etc.
The State Tax Service of Ukraine (hereinafter - STS) by letter № 3509/5/15-33-16 of 28.03.2013, reported that in accordance with the Procedure for the preparation and filling of tax invoice central enterprise may delegate to manufacturing subdivision or structural division of the company the right to entitlement of tax invoices. For that the taxpayer must each branch and the structural unit assign a single numerical code, what shall notify the STS Authority at the place of its registration as a VAT payer.
The Deposit Guarantee Fund (DGF) by decision № 19 of 20.03.2013 approved amendments to the Regulations on the withdrawal from the market of the insolvent bank, which, in particular, it is envisaged that the information on the implementation of the insolvent bank Provisional Authority, which is located by the Fund shall contain a message on obligations on payment of interest on deposits accrued in implementation of the interim administration, which resolved in accordance with the order established by paragraph 4 of Part 1 of Art. 52 of the Law “On the system of guaranteeing of individuals deposits”.
Additionally, it is envisaged that potential investors who are registered in Ukraine and eager to be involved at the conclusion of the insolvent bank from the market, should not apply to the fund certificate from the Unified State Register of Enterprises and Organizations of Ukraine.
